RETAIL SALES

(1) Introduction
  • These terms and conditions govern your use of our website; by using our website, you accept these terms and conditions in full. If you disagree with any part of these terms and conditions, do not use our website.
(2) Intellectual property rights
  • Unless otherwise stated, we or our licensors own the intellectual property rights in the website and material on the website. Subject to the licence below, all our intellectual property rights are reserved.
(3) Licence to use website
  • You may view, download for caching purposes only, and print pages or other content from the website, provided that:
  • (a) you must not republish material from this website (including republication on another website), or reproduce or store material from this website in any public or private electronic retrieval system;
  • (b) you must not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit our website or material on our website for a commercial purpose, without our express written consent;
(4) Limitations of liability
  • The information on this website is provided free-of-charge, and you acknowledge that it would be unreasonable to hold us liable in respect of this website and the information on this website.
  • Whilst we endeavour to ensure that the information on this website is correct, we do not warrant its completeness or accuracy; nor do we not commit to ensuring that the website remains available or that the material on this website is kept up-to-date.
  • Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise - including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.
  • However, nothing in these terms and conditions shall exclude or limit our liability for fraud, for death or personal injury caused by our negligence, or for any other liability which cannot be excluded or limited under applicable law.
(5) Restricted access
  • If you are issued with a Referral / Discount Code, you are not permitted to distribute the code to any other person unless you obtain written consent from JPS Communications.  We reserve the right to withdraw Referral / Discount Codes without notice if we feel that they have been abused or distributed. Our decision is final.

 (6) Law and jurisdiction
  • This notice will be governed by and construed in accordance with English law, and any disputes relating to this notice shall be subject to the exclusive jurisdiction of the courts of England

RENTAL AGREEMENTS

(1) Ownership
  • All equipment will always remain the property of JPS Communications and must be treated so in the event of hirer liquidation or insolvency.
  • JPS Communications will arrange recovery of all items at the request of the hirer.  Hirer shall be responsible for any damage / loss arising for mistreatment or failure to package radios appropriately prior to sending.
(2) Additional Hire Charges
  • In the event that equipment is not available for collection as per the hire agreement, we reserve the right to make a charge equivalent to the cancelled courier cost and additional hire charges (min 1 week).
(3) Loss
  • Hirer shall be responsible for any items lost.  Charges will be as follows for lost equipment.  These charges are reasonable to reflect like-for-like replacement of used items -
    • Handset - £95.00
    • Charger Base (Single) - £20.00
    • Charger Base (6-Way) - £140.00
    • Earpiece - £5.00
    • Charging Plug - £5.00
  • Other charges available on request
(4) Use of equipment
  • Equipment is for Commercial and Domestic Use.  Where Manufacturers specifications are clear, some items may be used in wet environments.  Some items may also be used in dusty environments.  Details of where these items can be used are included with the product description pages.
  • Any equipment damaged through use in environments that are not expressly permitted by the Manufacturer guidelines will be considered as mistreated and will be charged as per clause (3).
  • Our liability is limited and excluded to the maximum extent permitted under applicable law. We will not be liable for any direct, indirect or consequential loss or damage arising under these terms and conditions or in connection with our website, whether arising in tort, contract, or otherwise - including, without limitation, any loss of profit, contracts, business, goodwill, data, income, revenue or anticipated savings.
(5) Insurance
  • JPS Communications have insurance to cover any damage/injury caused as a result of use of the JPS Communications equipment.  This insurance is limited to occasions where the equipment has failed causing damage/injury and does not cover any consequential loss arising from failure of the equipment.
(6) Courier
  • The JPS Communications preferred courier is Royal Mail ParcelForce.  Unless otherwise stated, collections/delivering will be made between 0800hrs and 1700hrs Monday - Friday.  Orders placed on Friday - Sunday will be dispatched following Monday at the earliest (excluding Bank Holidays)
  • You will be notified of the courier being used and expected time of delivery
  • In the event that delivery is failed.  Additional attempts may be charged at £15.00 per delivery attempt.  This also applies to collections.
(7) Reserve the Right to Cancel Orders
  • JPS Communications reserves the right to make contact with the hirer prior to dispatching the equipment.  You may be required to provide Identification to confirm Name, Address and Date of Birth prior to items being dispatched.  We reserve the right to cancel any orders without notice for any reason.
